These Terms of Service ("Terms") govern your use of Kartha, a productivity application by Kartha Labs. By using Kartha, you agree to these Terms.

Acceptance of Terms

By accessing or using Kartha, you agree to be bound by these Terms and the Kartha Privacy Policy. If you do not agree, do not use the Service.

Description of Service

Kartha is a productivity application that provides:

• Task and project management
• Note-taking and documentation
• Habit tracking and routines
• Schedule and calendar management
• Counters and logging

Account Registration

3.1 Eligibility

You must be at least 18 years old to use Kartha. By registering, you represent that you meet this requirement. This is in accordance with the Digital Personal Data Protection Act, 2023 (India) and applicable international regulations.

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your credentials
• All activity under your account
• Notifying Kartha immediately of unauthorized access

Subscription and Billing

4.1 Free Trial

New users receive a 21-day free trial (3 weeks) with full access to all features.

4.2 Paid Plans

• Monthly: ₹300/month ($5/month)
• Yearly: ₹2,880/year ($48/year) — Save 20%
• 3-Year: ₹6,000 ($100) — Save 44%

4.3 Billing

• Subscriptions are billed in advance
• You may cancel at any time
• Refunds are subject to the Kartha Refund Policy

User Content

5.1 Ownership

You retain ownership of all content you create in Kartha ("User Content").

5.2 License to Kartha

You grant Kartha a limited license to:

• Store and backup your content
• Display your content to you
• Process your content to provide features
• Transmit your content for syncing

This license does NOT permit Kartha to sell, commercially exploit, or publicly distribute your content.

5.3 Your Responsibilities

You are responsible for ensuring your content does not:

• Violate any laws
• Infringe third-party rights
• Contain malicious code

Acceptable Use

You agree NOT to:

• Use the Service for illegal purposes
• Attempt to gain unauthorized access
• Interfere with the Service's operation
• Reverse engineer the software
• Resell or redistribute the Service
• Harass other users

Intellectual Property

7.1 Kartha's Property

Kartha's software, design, logos, and documentation are Kartha's intellectual property protected by copyright and trademark laws.

7.2 Feedback

If you provide feedback or suggestions, Kartha may use them without obligation to you.

Termination

8.1 By You

You may terminate your account at any time through Settings → Account → Delete Account.

8.2 By Kartha

For Trial Users: Kartha may terminate with notice when practicable.

For Paid Users: Except for serious violations, 30 days written notice and a pro-rated refund will be provided.

Immediate Termination: Kartha may terminate immediately for illegal activity, security threats, or fraud.

8.3 Effect of Termination

• Your access ends immediately (or at end of notice period)
• Your data is deleted within 30 days
• Backup data is purged within 90 days

Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED.

Kartha does not warrant that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KARTHA'S LIABILITY IS LIMITED TO THE AMOUNT YOU PAID KARTHA IN THE PRECEDING 6 MONTHS.

This limitation does not apply to:

• Kartha's gross negligence or willful misconduct
• Death or personal injury caused by Kartha's negligence
• Fraud

Indemnification

You agree to indemnify Kartha against claims arising from:

• Your use of the Service
• Your User Content
• Your violation of these Terms

Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of India.

12.2 Jurisdiction

Disputes shall be submitted to the courts of Karnataka, India. EU users may bring claims in their local courts as required by EU consumer law.

12.3 Informal Resolution

Before filing legal action, you agree to contact legal@kartha.app and attempt informal resolution for 30 days.

Mobile Application Terms

If you use Kartha via Apple App Store or Google Play:

• These Terms are between you and Kartha, not Apple/Google
• Apple/Google have no support or warranty obligations
• Apple/Google are third-party beneficiaries of these Terms
• In-app purchases are subject to App Store policies

Changes to Terms

These Terms may be modified with 30 days notice. Continued use after changes constitutes acceptance.

General

• Entire Agreement: These Terms constitute the entire agreement
• Severability: Invalid provisions do not affect remaining Terms
• No Waiver: Failure to enforce a right is not a waiver
• Assignment: Kartha may assign these Terms; you may not
